Who you're buying from

Noctius is run by YOUR FULL NAME, a sole trader based at YOUR BUSINESS ADDRESS, ENGLAND. You can reach us any time at hello@noctius.com. In these terms, "we" means us and "you" means the person buying.

What you get

A one-off payment gives you a personal licence to use the Noctius web app, including every update we release, for as long as we run Noctius. There's no subscription and nothing renews.

If we ever close Noctius down, we'll email you at least 60 days before. Your trades live on your own device, so you won't lose them.

Using Noctius

• You need to be 18 or over to buy and use Noctius.
• Your licence is for you. Please don't share your sign-in, resell access or copy the app.
• Noctius reads the history files you give it inside your browser. We never receive or store your trade history.
• Your trades are saved in the browser you import them into. Clearing your browser data removes them, so keep a backup (there's a button for it in the import window).

What Noctius is, and isn't

Noctius is for trading psychology, practice and planning only. It looks back at the trades you give it and shows you patterns in your own habits.

• It isn't financial advice. It doesn't give signals, tips or recommendations, and it doesn't tell you what to trade. We're not financial advisers, and Noctius isn't regulated by the FCA in the UK or the SEC or CFTC in the US.
• Practise first. We recommend trying any new rule or pattern on a demo account before you use real money.
• What-if figures are hypothetical. Numbers such as what breaking your rules "cost you", or how your account would have done if you'd kept your rules, are worked out after the fact from your own history. They leave out things like slippage, fees and how you'd have felt in the moment, and they don't predict or promise future results.
• Your decisions are yours. Trading forex and CFDs carries a high risk of losing money. You make your own trading decisions and you're responsible for the results.
• Not a health service. "Psychology" here means trading habits and discipline. Noctius isn't a mental health or medical service.
• Check your numbers. Noctius works from the files you give it. Check anything important against your broker's own statements.

Paying

Card payments are handled by Stripe and crypto payments by NOWPayments. We never see your full card details. The price you pay is the one shown at checkout, which includes any tax we're required to charge.

Instant access and your right to cancel

Noctius is digital content that you can use as soon as you pay. When you buy, you ask us to give you access straight away, and you agree that this means you lose the usual 14-day right to cancel for online purchases.

If something goes wrong

We work hard to keep Noctius accurate and available, but it's provided as it is, and we can't promise it will always be free of errors or interruptions. Because Noctius doesn't tell you what to trade, we aren't responsible for your trading decisions or any losses from them. As far as the law allows, our total liability to you is limited to what you paid for Noctius. Nothing in these terms limits liability that can't legally be limited, and nothing here affects your rights as a consumer.

Changes

We may update these terms, for example when we add features. The version that applied when you bought still covers your purchase, unless a change is required by law.

The law

These terms are governed by the law of England and Wales. If you live elsewhere, you keep any consumer protections the law of your country gives you.
